LIMITED LIFETIME WARRANTY

Pioneer Adhesives Inc. (PAI) warrants to the purchaser of the Product (the “Product”) that the Product carries a limited lifetime warranty from defects due to factory workmanship or materials; and, when properly used and maintained, in accordance with the Product’s manual or instruction guide, will serve the purpose for which it is intended.

PAI warrants to the purchaser the replacement or refund of the full cost of a Product found to be defective due to factory workmanship or materials. A maximum of three (3) pieces of the Product can be replaced or refunded by the purchaser during his/her lifetime. This warranty shall not include and extend to any damage resulting from accidents, negligence, misuse, abuse, wrong usage, alteration, tampering, failure of the purchaser to follow instructions as outlined in the Product’s technical data sheet or instruction guide, and/or use of the Product that causes damage to any substrate or material it was applied on, or any similar or related outcome that occurs in relation to the use of the Product.

CONDITIONS OF WARRANTY

This warranty is subject to the following conditions:

a) The purchaser must provide, along with the Product, the original proof of purchase (receipt), with original packaging retained, and photos of application, date, time, and location: (i) prior to use or application (if the defect was reasonably apparent prior to use); or (ii) at any time after the defect becomes reasonably apparent (if the defect was not reasonably apparent prior to use). In no case, however, shall a warranty claim be accepted and honored after the expiration date of the applicable shelf life of the Product (if any).

b) The Product must be used and/or applied in accordance with the relevant PAI’s technical literature current at the time of use and/or application. In case of use and/or application of the Product for a building or construction project, said project must be designed and constructed in strict compliance with all relevant provisions of the current National Building Code of the Philippines, its applicable rules, regulations, and standards.

c) PAI will not be liable for any claims, damages or defects arising from, or in any way attributable to: poor workmanship, incorrect design or detailing of the structure, use of the Product in unsuitable conditions, acts of God including earthquakes, typhoons, flood or other severe weather conditions or unusual climatic conditions.

d) Apart from those provided herein, PAI will not be liable for any other claims, damages or losses (whether direct or indirect) including, but not limited to, property damage, personal injury, consequential loss, economic loss or loss of profits, arising from breach of contract or negligence in relation to the use and/or application of the Product.

e) This warranty is not transferrable and cannot be relied upon by any other person other than the purchaser.

OBLIGATIONS OF PAI UNDER THE WARRANTY

PAI shall use all reasonable and practicable means to satisfy its obligations under this warranty.

Within sixty (60) days from presentment of a valid claim, PAI shall, at the option of the purchaser, replace or refund the full cost of the Product.

The refund provided by PAI pursuant to this warranty will constitute a settlement and release of all claims made by the claimant for damages or other relief. This will be the sole, exclusive remedy of the claimant, unless the claimant has rights, under applicable laws, which cannot be excluded or modified.

DISCLAIMER

The recommendations in PAI’s technical literature are based on good building practice but are not, by any means, an exhaustive statement of all relevant information.

As the successful performance of the Product depends on numerous factors outside the control of PAI (e.g. quality of workmanship), PAI shall not be liable for the recommendations in that literature and the performance of the relevant Product, including its suitability for any purpose or ability to satisfy the relevant provisions of the National Building Code of the Philippines, its applicable rules, regulations, and standards.

The statements in this warranty constitute the only warranty extended by PAI to the purchaser for the Product purchased. To the extent allowed by law, PAI disclaims all other warranties, express or implied including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose.

Nothing in this warranty is to be construed as excluding or modifying any rights of the claimant which cannot be excluded or modified under applicable laws.
